Regular License
The Regular License grants you, the purchaser, an ongoing, non-exclusive, worldwide license to make use of the digital work (Item) you have selected. Below are specifics that apply to your use of the Item:
Scope of Use: You are licensed to use the Item to create one End Product for yourself or for one client (a “single application”), and the End Product can be distributed for free.
End Product Definition:
- For templates: The End Product is a customized implementation of the template (e.g., a website theme customized with your content).
- For graphics and other standalone Items: The End Product is a work that incorporates the Item along with other elements.
Transferability: You can create one End Product for a client and transfer the End Product to your client for any fee. This license is then transferred to your client.
Reproduction: You can make any number of copies of the single End Product, provided the End Product is distributed for free.
Modification: You can modify or manipulate the Item, or combine the Item with other works to create derivative works. The resulting works must conform to the stipulations outlined in the scope of use.
Prohibitions:
- You cannot sell the End Product, except to one client.
- You cannot use the Item in a new logo, trademark, or service mark.
- Redistribution of the Item as stock or as part of a tool or template is prohibited, even if modified.
- Items cannot be used in on-demand applications where the end product is customized by the user.
Extended License
The Extended License includes all the benefits of the Regular License, but also allows you to sell the End Product, under the following conditions:
Scope of Sale: You are licensed to use the Item to create one single End Product which you can then sell to your client or to multiple customers.
Usage Details:
- The End Product may be sold by you or your client.
- The Item can be used in multiple projects, but a separate Extended License is required for each project.
Additional Permissions:
- You can make any number of copies of the single End Product and sell them.
- The license can be transferred to more than one client, provided a separate Extended License is purchased for each client.
Prohibitions:
- The Item still cannot be used in an application that allows end users to customize a digital or physical product to their specific needs without purchasing a separate license for each final product created.
- The Item cannot be redistributed as stock, even if modified.
General Provisions for Both Licenses
- Open Source Components: Some Items may be subject to open source licenses, in which case the open source license may override some terms of this license.
- Intellectual Property: Items that contain digital versions of real products, trademarks, or other intellectual property owned by others have not been property released and are licensed on the basis of editorial use only.
- Lawful Use: Items must be used in compliance with all applicable laws, including but not limited to laws relating to privacy, intellectual property, and the use of images of people.
Termination
- This license is revocable by Piksera if not in compliance with the terms and conditions. Upon termination, you must cease using the Item and destroy any copies of the End Product where the Item has been used.
